Annulment of Marriage
Successfully annulling a marriage returns the parties to a pre-marital state without the necessity of divorce. Once a divorce is annulled, it is as if the parties were never married.
An annulment is possible in the following circumstances, but there are exceptions and specific requirements for each of these. If you think you need an annulment, you should seek legal advice quickly, as some of these options have short filing deadlines.
Statutory Grounds for Annulment in Texas:
Underage marriage;
Intoxication resulting in marriage;
Impotency;
Fraud;
Duress;
Force;
Lack of mental capacity;
Concealed divorce (within the 30 days prior to the marriage ceremony); and
Marriage within the 72 hour waiting period after receiving the marriage license.
